Local associations are a great resource for learning more about regional requirements.<\/p>\n<ul>\n<li>US \u2013 CAN-SPAM Act<\/li>\n<li>Canada \u2013 CASL<\/li>\n<li>Australia \u2013 Spam Act of 2003<\/li>\n<li>European Union &#8211; Directive on Privacy and Electronic Communications<\/li>\n<li>UK &#8211; Data Protection Act<\/li>\n<li>Germany &#8211; Federal Data Protection Act, Telemedia Act, Act Against Unfair Competition<\/li>\n<li>The Netherlands \u2013 Dutch Telecommunications Act<\/li>\n<li>France \u2013 Article L. 43-5 Code of Postal and Electronic Communications<\/li>\n<li>Spain \u2013 Spanish Act on the Information Society Services and e-Commerce<\/li>\n<li>Italy \u2013 Italian Data Protection Act<\/li>\n<\/ul>\n<h2>WHO ARE YOU ALLOWED TO EMAIL?<\/h2>\n<p>A key goal of email laws is protecting citizens from receiving email they don\u2019t want. To help combat this issue, many laws require marketers to collect permission from the owner of an email address prior to any communication. This is usually done by asking people to <a rel=\"noopener\" href=\"https:\/\/litmus.com\/blog\/how-to-master-international-opt-in-requirements\" target=\"_blank\" rel=\"noopener noreferrer\">opt-in <\/a>to receive messages.<\/p>\n<p>One exception to this is the US CAN-SPAM Act. Under CAN-SPAM, you don\u2019t need consent prior to sending an email as long as you provide people with the opportunity to unsubscribe at any time.<\/p>\n<p><strong>Consent required:\u00a0<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Canada<\/span><\/li>\n<li><span style=\"font-weight: 400;\">UK<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Australia<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Germany<\/span><\/li>\n<li><span style=\"font-weight: 400;\">France<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Spain<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Netherlands<\/span><\/li>\n<\/ul>\n<p><strong>Consent not required<\/strong><\/p>\n<ul>\n<li>US<\/li>\n<\/ul>\n<p>Are pre-checked boxes allowed to collect consent?<br \/>\nWhile some jurisdictions accept pre-checked opt-in boxes and other forms of passive consent (e.g. during a checkout process), others are much more strict and require active consent. Countries that don\u2019t allow pre-checked boxes include:<\/p>\n<ul>\n<li>Canada<\/li>\n<li>Australia<\/li>\n<li>Germany<\/li>\n<li>Netherlands<\/li>\n<li>France<\/li>\n<\/ul>\n<h3>Consent record keeping<\/h3>\n<p>If an email recipient complains, it is the sender\u2019s responsibility to provide a valid proof of consent in front of courts. Therefore, always keep track of subscribers\u2019 IP addresses and the date and time of their opt-in, as well as the specific URL of the email acquisition source.<\/p>\n<h2>WHAT IF YOUR SUBSCRIBERS DON\u2019T WANT TO RECEIVE YOUR EMAILS ANYMORE?<\/h2>\n<p>On this matter, international laws agree: You must give your subscribers the opportunity to unsubscribe from receiving your messages. While there are different unsubscribe methods\u2014for example via call center or email reply\u2014providing a working unsubscribe link in every email is a must for every email you send.<\/p>\n<h3>The Unsubscribe Process<br \/>\nWhile each country has different guidelines around the unsubscribe process, here are some tips to keep in mind:<\/h3>\n<ul>\n<li>Don\u2019t charge a fee<\/li>\n<li>Don\u2019t require any other information beyond an email address<\/li>\n<li>Don\u2019t ask subscribers to log in<\/li>\n<li>Don\u2019t ask subscribers to visit more than one page to submit their request<\/li>\n<\/ul>\n<p>Providing an opt-out is required everywhere. The only difference is how much time you\u2019re allowed to take to process the request. If you take too long or don\u2019t process the unsubscribe at all, you\u2019ll risk getting fined.<\/p>\n<h3>Time allowed to process an opt-out request:<\/h3>\n<ul>\n<li>US: 10 business days<\/li>\n<li>Canada: 10 business days<\/li>\n<li>Australia: 5 days<\/li>\n<li>United Kingdom: 28 days<\/li>\n<li>Germany: as reasonable*<\/li>\n<li>France: as reasonable*<\/li>\n<li>Spain: 10 days<\/li>\n<li>Italy:\u00a0as reasonable*<\/li>\n<li>The Netherlands: 30 days<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">*Local laws don&#8217;t explicitly state a maximum time to process unsubscribes. Decisions are made case by case.<\/span><\/p>\n<h3><b>While Governments may give you up to 30 days to process an opt-out, <\/b><b>subscribers will not.<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">You face an increasing risk of spam complaints with each email you send to someone who has submitted an opt-out request. Subscribers know that brands can honor subscribes immediately in most cases, so taking more than a day or two may make them think that your unsubscribe process is broken. Fines for not complying with the law can vary based on a number of factors, including the nature of the violation, whether or not it\u2019s a repeated offense, and more.<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">USA<\/span> <span style=\"font-weight: 400;\">&#8211; up to USD 16,000 per email<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Canada <\/span> <span style=\"font-weight: 400;\">&#8211; up to CAD 10 million<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Australia <\/span> <span style=\"font-weight: 400;\">&#8211; up to AUD 1.7 million <\/span><\/li>\n<li><span style=\"font-weight: 400;\">UK<\/span> <span style=\"font-weight: 400;\">&#8211; up to GBP 500,000<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Germany <\/span> <span style=\"font-weight: 400;\">&#8211; up to EUR 4,000 per email<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Netherlands<\/span> <span style=\"font-weight: 400;\">&#8211; up to EUR 450,000<\/span><\/li>\n<li><span style=\"font-weight: 400;\">France <\/span> <span style=\"font-weight: 400;\">&#8211; up to EUR 750 per email<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Spain <\/span> <span style=\"font-weight: 400;\">&#8211; up to EUR 600,000 per infringement<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Italy <\/span> <span style=\"font-weight: 400;\">&#8211; up to 3 years imprisonment<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Compu-Finder, a Canadian training company, was slapped with a fine of CAD 1.1 million in 2015. According to the authorities, Compu-Finder had sent emails without consent, as well as messages in which the unsubscribe mechanisms did not function properly.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">CHECKLIST<\/span><\/h2>\n<p>Building emails that comply with international requirements can be hard, but following this checklist is a good start for staying on track when sending email internationally:<\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Only send emails to people who\u2019ve opted-in to receiving your messages. <\/span><span style=\"font-weight: 400;\">Keep records of those consents. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Include a working unsubscribe link in your emails. Make unsubscribing easy <\/span><span style=\"font-weight: 400;\">and honor unsubscribe requests as quickly as possible. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Make sure your subscribers can easily identify you as the sender. Include <\/span><span style=\"font-weight: 400;\">your brand\u2019s name within the mailing and choose a distinct from-name.<\/span><\/li>\n<li>Allow subscribers to easily get in touch with you. Include a valid postal\u00a0<span style=\"line-height: 1.5;\">address and contact email address in each mailing and make sure your\u00a0<\/span><span style=\"line-height: 1.5;\">reply-to email is working.<\/span><\/li>\n<li>Be honest.
